ETHICCRED TERMS OF SERVICE
1. Acceptance of Terms
By accessing, registering for, using, or interacting with EthicCred, its websites, applications, APIs, services, products, and related platforms ("Platform"), you agree to be legally bound by these Terms of Service. If you do not agree to these Terms, you must discontinue use of the Platform.
2. Platform Purpose
EthicCred is a professional passport, credential management, verification, certification, and professional record platform. The Platform may enable individuals, employers, educational institutions, recruiters, organizations, and authorized entities to create, manage, issue, receive, verify, store, share, and review professional records and credentials.
3. No Employment Guarantee
EthicCred does not guarantee employment, hiring outcomes, promotions, business opportunities, professional competence, character, ethics, trustworthiness, future conduct, income levels, or educational admissions. Users remain solely responsible for their own decisions.
4. User Accounts
Users must provide accurate information, maintain account security, protect passwords and credentials, and promptly notify EthicCred of unauthorized access. Users are responsible for all activities occurring under their accounts.
5. User Roles
Platform users may include individuals, students, interns, volunteers, employees, professionals, employers, HR representatives, educational institutions, recruiters, and administrators. EthicCred may create, modify, suspend, or remove role permissions at its discretion.
6. Professional Records
Professional records may include employment records, internship records, volunteer records, conduct certificates, experience certificates, recommendation letters, training records, educational records, and professional achievements. Issuing organizations remain solely responsible for records they submit.
7. Certificates and Recommendations
Certificates, recommendations, endorsements, evaluations, conduct assessments, and professional opinions are provided by issuing organizations. EthicCred does not independently verify every statement contained in such records and does not guarantee their accuracy.
8. Verification Services
Verification results reflect information available to the Platform at the time of verification. Verification should not be interpreted as a guarantee, warranty, certification of character, or prediction of future conduct.
9. User Consent
Users authorize EthicCred to collect, process, store, verify, display, and share information according to user permissions, platform settings, applicable laws, and platform policies.
10. Disputed Records
Users may challenge records they believe are inaccurate. EthicCred may request evidence, suspend visibility, add dispute notices, maintain records, remove records, or restrict accounts. EthicCred retains sole discretion regarding dispute management.
11. Prohibited Activities
Users may not submit false information, impersonate individuals or organizations, issue unauthorized certificates, misrepresent employment or educational qualifications, commit fraud, violate privacy rights, interfere with platform operations, attempt unauthorized access, scrape platform data, reverse engineer platform systems, or circumvent security controls.
12. Organization Responsibilities
Organizations must ensure that submitted records are lawful, authorized, and accurate to the best of their knowledge, and that necessary permissions have been obtained. Organizations bear full responsibility for records they issue.
13. Intellectual Property
All platform software, designs, logos, trademarks, databases, systems, content, interfaces, and intellectual property rights remain the exclusive property of EthicCred or its licensors.
14. User Content License
Users grant EthicCred a non-exclusive, worldwide, royalty-free license to store, process, display, reproduce, transmit, and use submitted content solely for platform operations, verification, security, compliance, support, and related business purposes.
15. Privacy
Use of the Platform is governed by the EthicCred Privacy Policy.
16. Security
Users acknowledge that no system can guarantee absolute security. EthicCred implements reasonable security measures but cannot guarantee uninterrupted or error-free operation.
17. Third-Party Services
EthicCred may integrate with third-party services. EthicCred is not responsible for the availability, accuracy, content, security, or actions of third-party services.
18. Fees and Subscriptions
Certain services may require payment. Fees, billing cycles, subscription terms, renewals, and refund eligibility shall be governed by applicable subscription policies.
19. Account Suspension
EthicCred may suspend, restrict, terminate, investigate, or remove any account or content for policy violations, fraud concerns, security risks, legal obligations, or abuse of platform services.
20. Audit Logs
Users acknowledge that EthicCred may maintain audit logs, access logs, verification logs, consent logs, security logs, and related records for compliance, security, fraud prevention, dispute resolution, and operational purposes.
21. Disclaimer of Warranties
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. EthicCred makes no warranties regarding accuracy, completeness, reliability, availability, fitness for a particular purpose, or non-infringement.
22. Limitation of Liability
To the maximum extent permitted by law, EthicCred, its officers, directors, employees, affiliates, contractors, and partners shall not be liable for employment decisions, hiring decisions, promotion decisions, business losses, indirect damages, consequential damages, reputational damages, lost profits, lost opportunities, or data loss.
23. Indemnification
Users agree to defend, indemnify, and hold harmless EthicCred from claims, damages, liabilities, losses, costs, and expenses arising from user content, user actions, policy violations, fraudulent submissions, or unauthorized activities.
24. International Use
Users acknowledge that the Platform may operate globally and that information may be processed, transferred, and stored across multiple jurisdictions.
25. Changes to Terms
EthicCred may modify these Terms at any time. Continued use of the Platform after modifications constitutes acceptance of the revised Terms.
26. Governing Law and Dispute Resolution
These Terms shall be governed by the laws specified by EthicCred in its legal notices and jurisdiction policies. Disputes shall first be subject to good-faith negotiation before formal proceedings.
